So, my 360 which I purchased on release date died whilst I was on holiday with the ole three red lights syndrome :mad:

I phoned M$ and the conversation went like this:

Me: "Hello, my 360 is broken with three red lights"
Some random bod in India: "Ok, because it's out of warranty you will have to pay for the repair. Do you have a credit card?"
Me: "Pardon?"
SRBII: "Do you have a credit card?"
Me: "Yes"
SRBII: "May I take the number so we can charge you for the repair?"
Me: "No, no you may not. I'll take this up with the retailer. Bye"

Using the awesome power of the internub I decided to check my rights as a consumer - best summed up here (http://www.dti.gov.uk/consumers/fact-sheets/page38311.html). Looking at that I figured I was well within my rights to demand a replacement / repair.

I drafted the following letter, and took a print-out with me into Game where I got the console from:

Just realised I have no idea where my receipt is. Although my 360 hasn't actually broken on me yet (bound to now), I would be in the same position as Moose. Anyone have any idea what position I'm in considering the lack of receipt? :confused:

Yeah, thats pretty awesome. It often pays to read the small print.

If you can bothered getting the facts and legal ****, its well worth it.

You do not need a receipt, it is not a legal requirement to be handed a receipt in the first place.

A bank statement or credit card will do. I exchanged mine at ASDA after mutilating the guy for being naive about retail law with my bank statement.

I haven't got that either. Infact I have absolutely no prove as to when I bought my 360.

I have to admit I was a complete tard when I bought mine. Payed with cash because I didn't have a debit card, and then lost the receipt. Just have to hope the damn thing holds together, no way I can afford to replace it.

I'm thinking it might well be worth throwing together an 'official' consumer rights thread. It's definitely something I'd like to know as much as possible about.

I lost my receipt for my first 360 but i just e-mailed Dixons and asked them to forward another copy of my receipt. I had all the information they needed as i bought the 360 online from them so it only took about 4 days for it to come though.

Cash is good but getting in debt does have a few perks lol.

Cool man, good on you man. I've gotten a few red lights recently but i bought mine through amazon so it maybe slightly trickier but i may give it a shot.

Reminds me of a news story i read. A guy bought blazing angels but found a fault in the game which the developers admit is there. He took it back to the shop wanting a refund but they said they can only exchange faulty products and do not offer refunds on opened games.

He tried explaining that it was a problem with the game itself, not just the copy he had. After speaking to the manager he was told the same thing again, he could not get a refund on an opened package so he opted for the replacement. He then turned around and asked for a refund and showed them his newly printed recipt and an unopened game.

They didn't like this and even called their headquaters to find out how they could get out of it. Eventually they gave up and gave him a refund.

lol my friend bought his of play.com hes on his fourth one already. he has spent more time buying stamps for it than actually playing it. the moral of the sotry is
"dont buy electrical, expensive equipment of the internet"

...n yes, proof of purchase in these situations are required else you have bugger all chance of pullin it off.

If they had said no, would you have taken them to court? I bet wherever you bought the 360 from can afford better legal representation that you, but that doesn't mean they would win...

"No" wasn't a word I was prepared to hear, especially when from what I could see my legal standpoint was quite strong.

I would've taken them to small claims court (link (http://www.hmcourts-service.gov.uk/infoabout/claims/index.htm)) - doesn't matter how much representation you can or cannot afford when going through there. In fact you don't even need a solicitor (http://www.hmcourts-service.gov.uk/infoabout/claims/small/index.htm), so bring 'em on I say!!
It's relatively inexpensive and can produce very effective results - in fact, just the threat of court is enough to make people see sense.

i concur. most of the bluster you hear in shops is just that. it's mainly there for people who just don't know what they're entitled to.

Well done Mr Moose. I began my campaign yesterday to get my first 360 exchanged because it only plays the games it wants to play now.

I sent a letter to the HMV Customer Services Department yesterday and if that brings no joy then I'm off in town to sort it out. As some of you know, I like a good argument.

See - this is why I taped my receipt to the box of my 360. How people laughed when I said 'I wont lose the box, and the reciept is attached to it' - WHO IS LAUGHING NOW!

All of 3 ppl...but they were advised that they just need "proof of purchase" and the actual receipt is not a legal requirement.
